My brother had to practice a warning shot when he worked as a prison guard.

You can be arrested for warning shots but not shots to kill. A warning shot shows you did not believe yourself in imminent danger.

A shot to kill shows you thought there was no lesser option.

Thus, even if you shoot to miss, you are on firmer legal ground if you claim to have missed by accident.

Warning the enemy that you couldn’t hit the broad side of a barn?
