The Republicans, given the chance, will not hesitate to pack the courts should they ever lose conservative majority there, whether or not the Democrats had done so before them.
I saw a guy advocating term limits of 9 years, with a new justice being nominated every year. I still like the idea of 18 year terms with a new justice being nominated every other year, with the inclusion of solid regulations to prohibit idiots like McConshell from screwing with the system.
Could you imagine how it would have been if the nominee had been truly middle-of-the-road instead of politically to the far right? Middle of the road folks these days have a very rough row to hoe…. everyone is too extreme and if folks even suggested considering “compromise” all hell breaks loose. But, compromise as a concept leads to decisions that tend to be appropriate and helpful for everyone. But that concept is long, long gone.
“Court packing” is the only suggested “remedy” these days because it does not require a constitutional amendment to happen (unlike age limits or limits on terms). That said, there is a valid argument that we should tie (and limit) the number of SCOTUS justices to the number of federal judicial circuits—we currently have 13 (12 regional + the Federal Court Circuit in DC).
I’m wondering when the expression I learned when I was young — “What’s the worsT that can happen?” — got downgraded to “What’s the worsE that can happen?”, which I’m seeing more and more frequently these days.
