    The Cave Men win this round. But those who lose their rights must use this as a megaphone to call voters off the sidelines and into the voting booths (or mail-in ballots).

    While I harbor no illusions of Constitutional “originalists” actually adhering to the intent of the Founders, it is relevant at this time to consider how and why Roe v Wade was decided BY CONSERVATIVES, in a 7-2 (not close) decision, in which moral liberals joined with Nixon-appointed Constitutional originalists (hello, it was 1973, into Nixon’s second term).

    Roe v. Wade (410 U.S. 113 (1973)) was decided 7-2 — not even close — and written by Harry Blackmun, a REPUBLICAN appointee of Richard Nixon, citing personal liberty issues and the “intent of the Founders” since abortion had been legal in all 13 original states for almost 50 years, until Connecticut became the first to outlaw it in 1821.

    Why should a president under investigation choose a justice who will probably help decide his fate, let’s clear up this Russian meddling, and allow the voters a chance to have a say by voting in the 2018 midterms.

    tracman’s off his meds again… Ever notice that You ONLY hear cries of “Legislating from the Bench” when the Judges decide something the CONS Don’t like? When they rule the way the CONS Do like, it’s “They are upholding the Constitution.” Funny how that works like that’ isn’t it??

    By the way…Trump vows that he will overturn Roe v. Wade “automatically.”

    During the beginning of the third presidential debate, Trump came out hard against abortion. He affirmed that, if elected, he would appoint only pro-life justices to the Supreme Court and that Roe v. Wade would be “automatically” overturned. (That’s not how the Supreme Court works.) He would then leave it up for the “states to make a determination” on the issue.

    He also condemned late-term abortions by stating that “in the ninth month, you can take the baby and rip the baby out of the womb of the mother … on the final day.” (That’s not how late-term abortions work.) None of this is all that surprising—during his campaign, Trump has stated that “there has to be some form of punishment” for women who get abortions.

    The reason Roe is easy fodder for being overturned is the same reason Abood was gutted. It is poorly structured and it is based on a nebulous “right” that doesn’t exist beyond the minds of the Justices at the time.

    What we need is an actual Amendment that covers medical rights including abortion. I would also like to see a right to die amendment so terminal patients could choose to end their pain without the government interfering.

    No, I am NOT pro-life. Its just that I can recognize that there is a right way and a wrong way to approach legal and Constitutional issues. Creating new law by judicial fiat always leaves the door open to having the change undone.

    Better to get out and fight to amend the Constitution. While an Amendment might not be permanent, it is a heck of a lot more secure than a SCOTUS ruling on a topic not actually covered in the Constitution.

    Serious question: If Republicans (and likely some conservative Democrats) outlaw abortions but also refuse to help pay for birth control to prevent pregnancies and refuse to pay for welfare to help raise children born out of unplanned pregnancies, does that mean those children are the “unfunded mandates” Republicans claim to hate so much?
