Taken in tandem with SCOTUS’ punt on trump ’s immunity bid, this seems like an invitation for Jack Smith to supersede trump with inciting insurrection. After all, SCOTUS has now upheld the DC Circuit opinion that says there’s no double jeopardy problem with trying someone for something on which they were acquitted after impeachment.
Jack Smith could and should — today — charge trump with inciting insurrection in response to this order. It is the one Constitutional means to disqualify him, according to this order. No need to kick it back to congress, there’s already a law.
18 USC § 2383
“Whoever incites, sets on foot, assists, or engages in any rebellion or insurrection against the authority of the United States or the laws thereof, or gives aid or comfort thereto, shall be fined under this title or imprisoned not more than ten years, or both; and shall be incapable of holding any office under the United States.”
The CO lawsuit was brought by a member of their GOP.
As for me, I’d rather see him on the ballot, get whipped and let him whine. However, it is interesting how all of the “states’ rights” advocates are silent. Maybe not so originalist (since elections are the responsibility of the states) after all?
Except that it wasn’t Democrats who brought the suit, it was a republican. Certainly Democrats cheered it on, but it wasn’t some sort of election interference conspiracy. Most Democratic politicians were staying away from it.
Hitting the Dems in the head with a gavel will either smarten them up or cause them to come up with more whacky ideas. Can we predict the presidential immunity case also comes out 9-0?
It was the right decision, allowing each state the right to throw our elections into chaos is a bridge too far. Congress needs to pass a new voting rights act.

I’ve always been curious as to why there’s such gloating over something that most experts said would happen. While I know this is part of our makeup as humans, most people overcome it after they get out of their teens.
Is the need for validation so great? Is it the failures of the Hunter Biden impeachment? Will the same childish, churlish reaction occur if the USSC rules against Trump’s immunity claims?
Fine by me if Dementia Don wants to get beat yet again. He’s nearly bankrupt as is the RNC so it’ll be fitting to take down every other republican down the ballot in November
Yes, very dramatic. The only fly in Mr. Gorrell’s ointment is that Norma Anderson, the lead plaintiff in the case, is a dyed-in-the-wool Republican. But there’s probably no rule that political cartoonists have to read the news.

Republicans didn’t seem to have a problem with keeping Obama off the ballot.

There’s a reason SCOTUS has a 15% approval rating, the RNC is going bankrupt, and less than 38 million Americans are registered as “Republican”.
The majority of U.S. citizens have a moral code that doesn’t blow whichever way the wind blows or give into threats of violence.

Breaking News. Democrats quietly refile disqualification brief with the Supreme Court asking if they could instead ban Joe Biden from the ballot. s/
