And it all boils down to “the courts either play politics or try to keep from making politically charged decisions”.
The decision is a “Duh”, yes, Graham has to respond to a subpoena, just like any other citizen. The 11th circuit, to keep from making a decision, doubtless hoping they won’t have to if they can drag out the clock past the midterms, sent the decision back to the trial court, to see whether the case somehow related to legislation being discussed in Congress, which is not subject to a subpoena.
Now (A), they could have done that themselves (actually, had a clerk do it) in fairly short order. And (B), Graham brought it up before the original judge, who’d already ruled that there was no relevant legislation before the Senate. (Seriously? Wouldn’t they have heard about it if there was a bill proposed to allow federal elected officials to change the totals in state election? Good grief!)
They’re just hoping the lower court judge gets mad enough to let it languish instead of taking it up and sending it right back to them.
He gets the chance to have his day in court to tell how much he loves the former president and espouse all of his MAGA beliefs and rave about how the election was stolen and he turns it down? What is wrong with all these loudmouths that they have so much to say until they are on the record. Weaklings and hypocrites all!
He’ll get his day and need to remember that the court of public opinion as captured by microphones of the press don’t have the same strict rules as a court. Lying Lyndsey may face contempt of court.
