This truly is troubling and dangerous. Traditionally, due process requires that application of a law that raises a substantial question of its constitutionality be stayed pending a thorough examination by the courts, particularly in a situation where the harm it causes is time sensitive and irreversible.
Whether you are for or against the right to choose, that right currently exists and has since 1973. Typically, state laws that attempt to restrict this right place enforcement of these restrictions in the hands of a the local prosecutor or a medical licensing board. Our concepts of sovereign immunity and federalism generally do not permit the courts (state or federal) to issue a stay against the “government” generally when it enacts an unconstitutional law. That stay is issued against the public official (local prosecutors, attorney general, governor, agency head, etc.) responsible for enforcing the law. The Texas law creates a ruse where theoretically all citizens of the state individually are enforcers of the law who would have to be brought into the lawsuit and enjoined from engaging in enforcement activity. Texas might just as well have said it is against the law to say that our law is against the law.
Laws similar to the Texas law are normally struck down because they are deemed restictiive beyond the spirit of Roe v. Wade. A rational legal system cannot immunize a law, even temporarily, from constitutional scrutiny when that law so obviously violates the existing constitutional standard.
Anyone considering the Supreme Court’s action a win for their side should remember that this nonsensical sword is bladed on both sides.
We must remember that the Nazi courts of Germany in the thirties and forties acted to support Hitler just as this court supports the America Nazi Republicans.
The Con’s on the Supreme Court have showed they have no interest in upholding the rule of law.
The Texas law is written to let snitches ruin women’s lives on a whim, to no consequence to themselves. The lawyers will have to be careful not to get disbarred for presenting the more obvious frivolous suits, but not sure that will be enough to deter all lawyers. Especially, those looking for some free advertising and publicity.
The right wing Supreme Court has now signaled to every red state to start up their own bounty on women who have had abortions. Republicans are total criminals.
