Today Elly introduces a completely new idea of the courtroom, one where a trial starts and the defendant who has chosen to defend herself is so hopelessly overwhelmed that an attorney she has never met will be appointed to help her.
My understanding is that Canada does not have a public defender program, but has a Legal Aid Program for economically disadvantaged persons accused of serious and/or complex criminal offences and facing the likelihood of incarceration. In other words, people not like Elly Patterson.
I am a little confused on the process going on here. Normally the person charged is called up first , the charges read a plea entered and the evidence begins with the prosecution going first and evidence submitted, then the defence has its say.
I used Legal Aid to get a divorce. I owned nothing except a very old car and was going to school. The guy was very nice. Not owning property and not having children made it very easy.
Looks like Lynn threw in everything she saw on TV and what happened to her when she went to court, since so far the strip has no resemblance at all to the cases I’ve seen or been part of.
It’s all rather confusing. I thought Elly had a traffic ticket. Why is the other party in court with a lawyer? At best he’d be a witness for the prosecution.
She took a fool for a client instead of just paying the fine. no preparation at all. No photographs of the area, a nice map to show the judge what all went where etc.
Elly, you are in a civil court. You were ticketed for an illegal left turn. Prosecutors don’t appear for those type of cases. They prosecute criminal cases – at least in the U.S. They don’t appoint public defenders for civil court cases – you’re on your own. You have to pay for your own legal representation – which is why most people skip civil courts. Elly apparently went to contest her ticket not knowing how the system works. NOW, why is the prosecutor in court for Pervrett? If this were an American court, I would assume Pervrett committed a felony civil code….maybe passing a school bus for ANY reason is a felony in Canada?
We don’t see what the prosecutor is saying, but I have been given the privilege of seeing the transcript:
Prosecutor: Your honour, is this a civil trial or a traffic court or a comedy courtroom that exists for no other reason than for the woman behind me to make a complete fool of herself?
Judge Sullen: Comedy courtroom.
Prosecutor: In that case, may I recommend that we just bring the woman to the front so she can do her comedy act and get it over with?
Judge Sullen: I have no objection to that. Mr. Pervert?
Pervrett: That’s Pervrett, not Pervert.
Judge Sullen: Right and I am not Judge Will Be Sullen.
Pervrett’s lawyer: We have no objection to Mrs. Patterson stepping to the front and performing her comedy routine, as long as you don’t decide my client is at fault.
Judge Sullen: No problem. The only person at fault in this case is the writer. She is totally to blame for this ridiculous story. Mrs. Patterson, are you ready to look like a complete idiot?
Elly: I am your honor. Soon you will laughing yourself silly.
Judge Sullen: We can only hope your material is better than that awful, “On my honor, I object” joke.
Elly: It will be. I plan to swing my arms and do a lot of mugging and also, I am going to get the giggles.
Judge Sullen: Hilarious. Please proceed to the witness stand.
