Neely had a long police record of walking up to people and punching them. The police took him to Bellevue where he’d be repeatedly released within a few days…and do it again. This broken system is the reason Neely is dead.

This case lends itself for the broad, sweeping statements about homelessness, mental illness, crime run amok, etc. Many are posted above. How about focusing on this particular incident? The question is, could this individual have been stopped short of his death?

In self defense cases if someone dies questions have to be asked about how far you had to go to protect yourself or others. Was the aggressor armed? Did he actually attack any one? Was he unusually large and threatening? Was restraint the only recourse to protecting your self? Choke holds are dangerous and people die from them. Asking those questions is legitimate and the City has a case against Mr. Penny.
And finally, is Mr. Ramirez seriously holding Batman up as an answer to urban crime?
I saw Neely numerous times on the Subway. I’d usually give him a dollar. He was fairly talented. There were times that he seemed a bit menacing, but I’m really sorry he was killed.
I understand the common parlance, but the GS in the parable assisted the victim, by seeing that the victim received food and medical care at the expense of the GS.
I don’t propose to prejudge Mr. Penny. The parable simply does not address the legal or moral issues of self defense or defense of another. Hence the analogy is inapt.

Open season on the homeless has been the plan for the GOP for years. Condemn the homeless, offer no solutions to the homeless problem. I hope people understand that the issue in this case is not the choke hold but applying it until the victim was dead. If the victim had been white and the ex-Marine Black, HOLY SPIT ON FIRE WE NEED TO CONVICT!
