It’s fair to try to convince him that it’s time to retire precisely out of fear of never getting a chance again to replace him with a more progressive justice. It has nothing to do with his ability, only his age. However, there is time. Biden should have a young nominee picked our, and the Dems should ram them through the second Breyer retires. Assuming it’s in the next year and a half, of course.
But wouldn’t it be nice if a couple of folks on the more conservative side chose now for an exit?
Will the “United” States ever have fair, impartial, courts when judges are approved by politicians — in a winner-take-all election scheme — disproportionately represent the US population?
Had a dream last night. In it, Breyer held on through next year. Then both the House and Senate changed hands after the ’22 elections. Then Breyer croaked in early ’23, and McConnell blocked any replacement SCOTUS nomination. McCarthy became speaker. Biden died shortly before the ’24 election. Harris was defeated by Trump and MTG in ’24. The GOP retained control of Congress and secured a super-majority in the Senate. The dream went downhill from there.
RBG should be the ultimate warning to any Justice who wants to hang on till the end. If Breyer sticks around and we are even one seat down in the Senate, then Moscow Mitch will block ANY nomination that is put up by President Biden.

I absolutely understand the concept of lifetime appointments, but when folks live into their 90s, it just does not work out as it was meant to when the life expectancy was 68. I do tech support. I know 90 year olds who are sharper than me. But I have also worked for people who believed they were still competent 20 years after they were not. Sadly, that is the norm. Worse, they are sometimes in charge of things they know nothing about. Time to update Judiciary protocols.
