As I believe the “meme” goes, you have to take it before it’s actually served, so the guy should not have said “you’ve been served” before Barney actually had it in his hand, and Barney should not have taken it after he heard him say it…

He’s been given a summons to appear in court. A process server delivers the summons. He’s probably being sued.
Paying off is the cost of doing business since they never go to prison.
