The next Supreme Court justice will sit on the tribunals that decide important Constitutional issues regarding the role of a president under investigation.
A president, while under formal investigation, should not be allowed to appoint the judges that will be the final arbiters of issues in his own case. That is certainly a more compelling basis for denying a presidential appointment four months before an election than denying a president not under any formal investigation for almost a full year.
(And please, spare me any talk of a “Biden Rule.” Joe Biden put up a trial balloon about not confirming a nominee in an election year (1992), it never went anywhere, the Republican nominee was not denied hearings, not denied a floor vote and, in fact, was confirmed. His name is Clarence Thomas and he still sit on the Supreme Court today.
Complacency — letting two entrenched parties block independents from having a voice — has taken us to this point; is the two party system working for we the people or is it benefiting the parties and their wealthy sponsors? Should extremist partisan politicians pick our judges?
John Adams wrote in a letter in 1780: “There is nothing which I dread so much as a division of the republic into two great parties, each arranged under its leader, and concerting measures in opposition to each other. This, in my humble apprehension, is to be dreaded as the greatest political evil under our Constitution.”
