    Attorney–client privilege 101 —

    The crime-fraud exception renders the privilege ‘moot’ when communications between an attorney and client are themselves used to further a crime, tort, or fraud.

    Clark v. United States:

    "A client who consults an attorney for advice that will serve him in the commission of a fraud will have no help from the law. He must let the truth be told.” – U.S. Supreme Court

    Both Trump and Cohen have declared, while knowingly being recorded, that there was no communication between them about Stormy and the illegal campaign contribution.

    So, exactly what is it that is privileged?

    So the Rump says he didn’t know about the payout to Stormy. Thus indicating that Cohen may have acted illegally, and there was no legal agreement made. Only the Rump is making claims of breach of privilege, through his usual reactive rantings.
