    Since it is unlikely that Obama, or Hillary, or Bernie are going to nominate a Scalia clone, there is one more option. Have the Great Man cryogenically preserved, animatronically responsive, and prop him up in his robes on his Supreme Court seat giving the proper response on demand. It’s worked well for Clarence Thomas for fifteen years.

    The Democrats voted unanimously for Scalia, even though they disagreed with him. Because they recognized who was president, and that the candidate was qualified. The Republicans say that Obama shouldn’t even nominate someone, because they cannot accept his presidency. The will of the people is to be opposed at all cost. There is no equivalence between these two stands. You can no longer claim to be both Republican AND an American. You have to choose one or the other. Do you support the Republican party? Or do you support the American system of government? They are incompatible.

    The greedy republicans continue their naked power grab to subvert democracy. They want everything their way so they can tell you what to do. The American people should demand that they disband as they have done nothing but hurt the country for seven years.

    The people spoke and reelected Obama in 2012 the Senate should at least consider a nominee that Obama puts forward. He was elected to do his job through Jan 20, 2017, hopefully the people in the senate and the White House can find a consensus candidate. It seems the Republicans have decided they wouldn’t even hold a vote on a new Supreme Court nominee until after the presidential election. This seems like they are not doing their jobs and it troubles me. When a Supreme Court justice retires or dies in office, the Constitution dictates that the president must nominate a replacement with the “advice and consent” of the Senate. Under Senate rules, Democrats must find 14 Republicans to have enough support to cut off debate on a nominee and allow a simple majority vote on his or her appointment to the court. So far not a single Republican has said they would vote on an Obama nominee before the election.The partisan divide is striking, and I don’t see both sides throwing tantrums.

    Back in 1970 Mitch McConnell said that a president should be able to pick a Justice who would be in line with his political views:“What standard then can be drawn for the Senate from the experiences of the past year in advising and consenting to Presidential nominations to the Supreme Court? They have been set out above but should be reiterated in conclusion. At the outset, the Senate should discount the philosophy of the nominee. In our politically centrist society, it is highly unlikely that any Executive would nominate a man of such extreme views of the right of the left as to be disturbing to the Senate…The President is presumably elected by the people to carry out a program and altering the ideological directions of the Supreme Court would seem to be a perfectly legitimate part of a Presidential platform. To that end, the Constitution gives to him the power to nominate. That wasn’t a blanket refusal to consider any nominee, it was directed at a specific nominee. Obama felt that Alito’s views were much farther to the right than the hearings suggested. It turned out Obama was absolutely correct. Alito has actually been more conservative than Thomas or Scalia.In 2007, Schumer suggested Democrats should not vote to confirm any Bush nominee other than under extraordinary circumstances. He took that position after seeing how Alito turned out. There’s fair criticism to be made in Schumer’s over reaching.

    A blanket refusal to to even consider any nominee is childish & could hurt the conservative cause by having a likely moderate nominee be replaced by one who is far more liberal next year.

    You thought there was a presidential election in 2014? I’m talking about the presidents constitutional duties. not the 2014 elections – which were not for the president. It is the president who nominates the Supreme Court Justice. Is this why the right wing is confused?

    I’m actually talking about what is happening now. I’m sure you were very forgiving of Obama for using the tools given to him as a Senator when it happened. However, I’m talking about the situation today, and how they are depicted as babies throwing tantrums. Now if you take what is happening today, you see one side is looking to nominate a new Supreme Court Justice. And the other side is saying we won’t entertain the approval process. I haven’t forgotten, it just doesn’t have anything to do with this toon.

    Scalia was confirmed 98 to 0. The toon is totally false, the hissy fit chairs are all filled with Republicans this time.
