The job of the special prosecutor is to lay out the facts, not editorialize about them. It is the same reason James Comey was criticized for dropping the charges against Hillary Clinton (but not against Trump which remained under investigation in Fall 2016) and then making irrelevant disparaging remarks interjecting his own opinions into a presidential campaign.
Merrick Garland and Jack Smith have bent over backwards to demonstrate objectivity and impartiality. Special Prosecutor Robert Hur, from the Trump “Justice” Department, went out of his way to interject personal animus and irrelevant subjective opinion.
Example: the document made a subjective evaluation of Biden’s memory, which the attorney, not a medical or psychological expert, was not qualified to do. He wrote, that Biden “answered painfully slowly.” Painful? Really? Who was in pain? Biden speaks slowly and with deliberation. If he had to interject a subjective opinion, he could just as well have stated, “Biden answered with careful and thoughtful deliberation.”
FACT: None of the actions of Joe Biden rose to the level of a crime. Like Trump and Mike Pence, he inappropriately had some documents improperly held after leaving office and improperly storing them in inappropriate conditions at his residence.
Like Mike Pence, Biden’s actions seemed largely inadvertent and, when discovered, he cooperated fully with authorities, including voluntary searches of the premises, and all documents were immediately returned without the need for warrants or subpoenas. In contrast, Trump refused to cooperate, refused to return documents and attempted to conceal evidence and obstruct justice.
