    This may make sense to people who have a clue as to what “Prop 19” is, but that doesn’t include me.

    California Proposition 19 (also known as the Regulate, Control & Tax Cannabis Act) was a ballot initiative on the November 2, 2010 statewide ballot. It was defeated, with 53.5% of California voters voting “No” and 46.5% voting “Yes.”1 If passed, it would have legalized various marijuana-related activities, allowed local governments to regulate these activities, permitted local governments to impose and collect marijuana-related fees and taxes, and authorized various criminal and civil penalties.2 In March 2010, it qualified to be on the November statewide ballot.3 The proposition required a simple majority in order to pass, and would have taken effect the day after the election.4 Yes on 19 was the official advocacy group for the initiative and California Public Safety Institute: No On Proposition 19 was the official opposition group.5

    Saying no is easy. The tricky part comes when the no is ignored. In this case, the physical throwing and locking out of the kid.

    My Son and his wife are moving back in with my wife and me. We want them to. My wife’s grandson, his wife and 3 babies )5,2 & almost here) are living with us. Too big a house, 4 bedrooms 3 bathrooms 2500 sq ft is too big for us ( my wife calls me on the cell phone when dinner is ready instead of yelling) and can’t sell it for what it is worth. Paid for. All get along. Nice times.

    The problem with it is that it was directly apposed to federal law. It would have brought up the arguement does federal trump state law. California would have had to go court to inact it. If they won states could make laws counter to federal law. The ruling in Roe v Wade was basicly not on abortian but who had the higher authoirty. The court ruled that the federal goverment was the law of the land therefore it was legal in all states. Prop 19 inadvertantly would have challenged this. So you could have got stoned in Cal but not get a legal abortian in Utah.

    Well it is not really counter to Federal law. The states do not have to make anything illegal, even if the Feds do. While it might have become legal under California law to possess and grow marijuana it would not have changed the Feds ability to prosecute under Federal law.

    Quite simply the change would have meant only that California would stop prosecuting under state law. It would have no effect on Federal law or Federal prosecutions. For instance the medical marijuana laws a couple of states have passed do nothing to change the fact that under Federal law it is makes it illegal to sell marijuana.
