I’m sorry to say this, but that can of worms NEEDED to be opened. We can’t allow lawbreaking and abuses of human rights to go on under the cover of “national security”.
Otherwise, future presidents can do whatever they want (break laws, disappear people, torture civilians, spy on citizens, or, if you want the Righties to get up in a tangle: ban guns, demolish churches, outlaw religion, redistribute wealth to everyone equally, etc.) to whomever they want and hide from justice.
Does anyone want the Executive to have that kind of power?
I don’t. And that’s why we needed that can of worms opened. Too much bad stuff was going on in there to be kept secret. We have followed the law for over 200 years, and we’ve gotten very good at what we do. We can’t do away with that because there might be some lunatics out there (which we’ve dealt with in the past and taken care of WITHOUT destroying that which makes America “America”).
Dick Cheney is talking about all his rationale for the use of torture and soon it should be time for him to answer questions from a special prosecutor. I hope that gets started in the next 6 months. In the meantime the Army grunts at Abu Garab should have their lawyers appeal their cases.
