We have SCOTUS because ambiguous laws need be interpreted. Our representatives (mostly lawyers) write ambiguous laws to skirt around the objections of “other” legislators with a different view rather than reconcile the law into a non-ambiguous form. It seems that if we had a non-opposing Congress that worked together, we could avoid a lot of time, effort, and tax-payer money and not have to worry about partisan bias in SCOTUS.
We have current problems that are being neglected so that our politicians - who seem to have traveled through time from 40 years ago - can debate fringe ideological abstractions that the majority of the public no longer care about.
If there was no such thing as a Democrat or Republican judge, the GOP would have done their job a year and a half ago and given Garland an up or down vote. Now that the president is the right color, the Republicans are going to start looking at the Supreme court again.
