Is it Dang! I was chosen or Dang! I wasn’t chosen? From his inner dialogue I thought he did not want to be noticed.

A friend of mine (God rest his soul) was called for jury duty on a court-martial. Knowing that the attorneys had peremptory challenges, where they could have a juror removed from the pool for no reason at all (or at least, they didn’t have to state a reason), during a recess in jury selection he leaned against a wall within earshot of where the defense attorney was standing and muttered in a stage whisper, “I hope this b@stard fries.” When court was reconvened, the defense attorney wasted no time in pointing out my friend and demanding his dismissal. Well played, friend, well played.

K M: Your friend was struck for cause. Since the questions always include something about made-up minds, he could be struck for cause, and if he says that in hearing of the venire, could be charged with contempt or even perjury depending on how he answered the prejudice question. My technique is to quote the Constitution at some relevant part of the voir dire. One side or the other will definitely use a peremptory on you, making minute improvement on the final jury.
