I get your point. I don’t think you’re getting mine. When Medicare Part D was passed, no one cared about the individual mandate. When it was included in Obamacare, it was suddenly unconstitutional. I was pointing out a disconnect, which is a valid one, and persists to this day.
Actually, when my state’s AG took Obamacare to the SCOTUS to protest the individual mandate, I asked him if he would do the same for the mandate in Part D, as it was the same thing. I asked three times. The first two times I got an answer that did not match the question. The third time I did not get an answer. Typical politician.
