One of the issues with the Pirate Bay issue has to do with the fairness of the trial. There were quite a few problems with how the whole thing was handled.
I believe the copyright on downloads is for a single user- the person downloading, and not for resale. They may allow you to put it on more than one machine that belongs to the purchaser, like computer -ipod-cell phone. Copyright remains with author, unless they sell it. MIchael Jackson’s real income came from the Beatles collection and other titles he bought rights to, not his own music.
Sat- not the same thing. If you buy a record or CD you can sell it, like at a yard sale, or give it away. If you download something, then COPY it (or a DVD/CD)and sell that COPY= copyright infringement. Anti-pirating software is becoming more “sophisticated” on music, and audiobooks. Some book downloads are good for a period of time, then “self - destruct”. (Mr. Phelps) Computer “trial software” does the same thing.
If I sell my books, I like getting the royalties on the copies sold, rather than selling one copy, and having 3,000 being pirated and someone else taking the money for the original work.
To help with Sat’s analogy… the record company should replace my scratched copy of a CD because I already paid for the copyright part and the medium has now become damaged…. not my right to the material.
The format is the only difference between having the right to re-sale and not. And that is pretty weak considering the price is the same.
