Here’s hoping that the Democratic minority in the Senate (and the Senate Judicial committee) can run out the clock on Barrett’s nomination between now and the election, as well the lame duck Congress between Election Day and holiday recess. If that happens, perhaps Biden can renominate Merrick Garland to fill Ginsburg’s seat. But, if Barrett’s confirmed, Biden should keep Garland in the loop should Thomas, Breyer and/or Scalia either die, fall ill or retire. Or if he decides to expand the number of justices and/or institutes a 14 year term limit on Justices.
There are several options open to democrats if the republican Senate actually pushes the Rabbit’s nomination through to seat her as a Supreme Court justice – the one I personally prefer is seating three more justices on the Court once we take back the Senate.
It will be argued that that road leads to anarchy, or worse!
I will merely note, for the record, that Moscow Mitch and his gang of Putin sycophants in the Senate have already destroyed whatever “norms” existed in the Court selection process and that any arguments to the contrary are specious, at best.
The addition of judges to the court is merely a step in correcting the court’s balance so that it represents the American public’s attitude!
The Federalist Society, who have been instrumental in the judicial selection process to this point, represents an extreme minority of the populace and yet they have been allowed to truly “pack” the judicial system, to this point.
