Most recently, two of his cases made it all the way to the Supreme Court this week (one on appeal from a Pennsylvania court and one on original jurisdiction) and, in both cases, as to the substance, he was UNANIMOUSLY tossed out, including by the justices he hand-picked.
In the Pennsylvania case, it was a straight one-sentence denial with no dissent, issued 34 minutes after the case was received by the full court.
In the case in which the state of Texas sued four other states, thus being a state-to-state lawsuit making it eligible for the Supreme Court’s original jurisdiction, as to the substance, the rejection was, again, unanimous. But owing to Samuel Alito’s long-held position that any case eligible for original jurisdiction should be at least heard, he added an opinion that the case should at least be heard, but said he would not be willing to grant “any other relief.” Alito’s dissent on process was joined by Clarence Thomas.
The cases have gone all the way to the Supreme Court.
