It just occurred to me (why did it take so long?) that if this case does eventually reach the Supreme Court, Trump — as the individual who declared and “defined” the “emergency” — will be forced to actually testify in person.
No Giuliani as a standin. No preselected list of “questions”. No “executive privilege”. Just face-to-face questions and answers.
Given the nature of the issue under review, I think even Kavanaugh might balk at giving him a pass on appearing in person.
