The thing to remember about “fire in a crowded theater” is that it’s taken from a Supreme Court decision upholding a conviction for pamphleteering against the military draft.

Nobody ever had the right to say whatever they wanted. Throughout this country’s history, people have been imprisoned for saying things that were unacceptable to the community of the time. Why, when I lived down south, I once got in trouble for even mentioning the word, “Union.” And no, I am not making that up. When another local began saying in public that a union should be formed, he got death threats.

Do you remember when the Republicans were publicly stating it was wrong to criticize the President when troops were in harms way? Do you recall some of them going so far to say it was treason?
