You are correct, RasDaoud; the only Constitutional remedy by which a sitting senator or member of the House of Representatives can be removed from office is not impeachment, but expulsion by his/her fellow senators or representatives.
President Barack Obama should first nominate a well-regarded moderate such as Sri Srinavasan or Jane Kelly (from Judiciary Committee chair Chuck Grassley’s home state of Iowa) (both of whom were recently confirmed by unanimous Senate votes for federal appellate judgeships) and then, when the predicted obstruction materializes, follow up with a RECESS APPOINTMENT of Loretta Lynch or, heck, Eric Holder)..Then, after the one-year ceiling on a recess appointment expires next year, new President Hillary Clinton should nominate a well-regarded professor of Constitutional Law: Barack Obama to be confirmed by the new Democratic Senate majority after a high-turnout election in 2016 (in which the Republicans are defending all those senators who won in the 2010 TEA party sweep in swing states) returns to a Democratic Senate majority.
I swear the Republicans didn’t just shoot themselves the foot here, they blew it off with a twelve-gauge. Wonder how Mitch McConnell is going to like being Senate MINORITY leader again.
So from now on we wait until the NEXT president to select judges? Scalia was a “constitutionalist” when it suited his political needs, but he was the justice most likely to assert constitutional limits on the power of Congress and the president (including selecting a president for us). So where will we find a judge to replace Scalia that opposes the EPA because there is no end to pollution “from Frisbees to flatulence, qualifies as an ‘air pollutant’”? Where will we find someone willing to stay on cases they have had involvement with? Where will we find a judge who will attend one parties fundraising dinners? A Republican president would try to replace Scalia if the Senate can delay for a whole year. The right wing has been practicing for this moment for 7 years – the obstructionist tactic will finally pay off. This does prove they are not at all interested in the constitution and the Democrats are the party that uphold our founding fathers document. The unreasonable hatred for president Obama was big enough for the right to throw out the Constitution. I don’t know that they could entertain approval hearings at this point, it would put the debate squarely in the realm of ideology, and the constitution, the voters and the precedents are not on the side of the Republicans.
Is astounding how quickly the GOP throws the constitution out the window when it conflicts with naked partisan power. You’d think with all of the copies of the constitution they claim to carry around, they’d have read something besides the second half of the second amendment.
