    It should be illegal to use dead celebrities for commercials unless they actually gave permission before they died.

    They probably have to get permission from their estates or whoever owns the rights to the film the use.

    However newsreel footage of dead politicians may be in public domain and therefore may not require permission from dead person’s estate. Also old movies may also be in public domain. Hey! Nixon never had to give permission for the cult comedy movie MILHOUSE that used newsreel footage of him.
