In the primaries, Joe Biden reiterated the view he has long expressed: that he opposes politicizing the court, and that includes expanding the number of justices.
In the primaries, Pete Buttigieg and Elizabeth Warren (my first choice) both supported a structured expansion that would be fair to future presidents, a proposal that I supported and which Joe Biden opposed.
But now we are faced with a different situation. As Biden expressed in his ABC town hall (after Trump became the first president in 32 years to chicken out of a debate under the terms of the Commission on Presidential debates, which has always been chaired by a Republican), he still opposes politicizing the court and does not like the idea of expanding the court.
