I think there is too much documentary evidence that this was not merely paying a lawyer for the jury to find him totally innocent. However, I suspect that either it will be a mistrial because of a hung jury or they will find him guilty of illegally falsifying business records but not agree that it was to affect the election and therefore it’s a misdemeanor and not a felony.
Illegally falsifying business records with the intent to commit or conceal other crimes is what raises Trump’s actions to the level of a felony – the desire to keep the encounter with Stormy Daniels quiet so it would not be made public before the election actually is part of the formal charge.

No, in fact the paying of the hush money is not the crime with which Trump is being charged. The actual crime is that Trump illegally falsified business records by classifying his reimbursement of Cohen, executed by the Trump Organization, for the hush-money payment as legal expenses.
