One simple way to make tort suits more “responsible and valid”- mandate a maximum payoff to lawyers of not over 7 to 10% of the settlement, instead of their current “taking” of from 70% to 95% of such settlements. Same for medical malpractice, with a medical board of doctors and related experts in medicine, to review each case for validity before said suits are allowed to proceed to trial, a “grand jury” if you would.
There ARE valid cases, and reasons to sue, and valid reimbursement is appropriate, but not the ridiculous settlements LAWYERS get for themselves. BTW, we have 9 laywers in our small town, about the same lawyer/citizen ratio seems to hold across the country, and 7 of our lawyers are staunch conservatives, and Republicans, which I’d bet also actually holds.
Yes, we need tort reform, but not more protectionism for corporations or the willlingly harmful focused on the bottom line profits, not fixing errors. When costs of losing lawsuits, not engineering fixes dominate decisions at boardroom levels, there’s a problem.
Actually, my one positive to award Bush Sr. and yes even “W” was their support for the ADA, and daddy signing it. Too bad Junior later created so many disabled soldiers who will need prostheses or chairs.
Our tort system works in some cases, but in others it does not do a good job of compensating those who have been injured or correctly assigning the risk of loss for certain activities. -Silicon implant manufacturers, for instance, were forced to pay enormous sums on the basis of what what turned out to be junk science. Some were driven out of business, or into bankruptcy, for what turned out to be unfounded claims. Similarly unfounded or even factually frivolous claims permeate our legal system, dragging our economic activities and leading to a increasingly risk-averse and legalistic society as businesses do whatever they can to avoid liability, even if it means acting like jerks (which it usually does).-We need to reform our tort system to provide more fair results in contested cases, to protect our economy from waste, and to protect our society from the dehumanising effects of a litigious society. Unfortunately lawyers benefit greatly from the existing system and can be counted on to fight reform vigorously. Reform must nevertheless be pursued.
