    “Free advertising is always welcome.” Unfortunately not always true. A Seattle area steel drum band called The Toucans, who use a photographically accurate image of the tropical bird as their logo, applied for a copyright on their name, only to be informed that the Kellogg’s corporation objected because they feared that it would cause confusion to customers between the band and the animated cartoon character Toucan Sam. Apparently Kellogg’s not only thinks their customers are unable to distinguish a box of cereal from a steel drum band, but apparently feels they have a legal right to ANY commercial use of the word “toucan” or any image of a toucan. It seems they are concerned about their commercial image being tainted by a band that plays fun, happy, good-time danceable music. You would think (unless you a corporate legal jackal) (meaning offense to actual jackals), that as you said, having your product associated with happy good times, with no detriment to the image of their cartoon character, would be welcomed by the marketing weasels (no offense meant to actual weasels). This would no doubt be due to the fact that you are a reasonable and reasoning individual, as contrasted with a seven-gallons-of-goat-puke-in-a-five-gallon-bucket legal or marketing rep. I cannot help thinking that pursing this action favorably affected the public perception of Kellogg’s.
