It is up to Manchin and what’s her name. We might be shrewd.

McConnell is going to argue that it wouldn’t be fair to appoint a SCOTUS Judge until after the next election because “the people need to vote on a Senate to confirm the Judge”, after claiming that their outgoing Senate was reflecting the will of the people when they rammed Amy Covid Barrett through.

“We’ll just filibuster anyone Biden appoin-, oh crap! I forgot, we got rid of that rule for judicial nominations.”

McConnell philosophy: Don’t do what’s best for the country, but do what’s best for the ultra rich.

The tried and true McConnell rule simply states: “When you wipe your behind, use the Constitution”.

It seems that the present Senate can confirm Biden’s nominee for Breyer’s successor BEFORE the SCOTUS term ends in June. That person would be sworn after Breyer retires. It will still be a close thing though, given the constant, disingenuous, and grotesque grandstanding by Manchin and Sinema; both of them will have to fall in line and both are from states hot and heavy right wing regarding God, Guns, and Wade.

Fortunately, only a simple majority — in this case certainly 51/50 — is required for confirmation; SCOTUS nominations are filibuster-proof, as the past three have amply proved.

This will make for good political theatre. Anything to divert the Press from what is truly important to the US population, e.g., declining income and scarce food to put on the table.

I want to be optimistic and believe there will be a few Repubs that will vote for a SCOTUS nominee that Biden nominates.

Earlier today on CNN they were showing potential nominees, many of whom were previously vetted and confirmed for their positions on various Federal benches. The Republicans will have a hard time saying that they are not qualified and do not deserve consideration. I hope they ram the most liberal judge down McConnell’s throat.

It will be another far-right ideolog, installed after the requisite amount of Dem theater and cave-in. You heard it here first.

Wouldn’t Anita Hill be a delightful choice? Joe could correct a very egregious wrong he committed 31 years ago. Tip ’o the hat to Jimmy Kimmel.

Of course the Treason Tyrtle just doesn’t have a say in it this time.

    His obstruction won’t be effective.

Although probably not a single Trumpublican will vote for whoever Biden selects, no matter how qualified and appropriate!

New York Times will probably post an article with a lede like “Mitch McConnell says republicans will destroy the Senate building and reduce it to a pile of stones, none larger than a man’s fist, to stop this nominee. Here’s why this is bad news for Democrats in November”

We need to end lifetime appointments to the Supreme Court. Give them a long, single term (like 18 years) and set it up so that there’s a vacancy every two years. Every president gets to appoint two per term. If a justice dies, their replacement finishes out the term and does not get a full 18 years of their own. No more ghoulish deathwatches, no more “too close to an election” excuses, no more trying to find the youngest, most extreme nominees.
