    Why is it that, when they declare something to be unconstitutional, right wingers never point the article and section that it violates? More often than not, if asked, they point to the 10th amendment, so as to say that it is up to you to prove that it isn’t unconstitutional.

    First of all, it’s not unconstitutional to protect the general welfare. But strangely, Stantis and the other Qubs were just fine with X-45 running all over the constitution on a daily basis in golf shoes, and ignoring the welfare of 650K American citizens with his COVID shennanigans.

    SCOTUS has several times upheld the right of the Feds to enforce use of vaccines. Everybody (almost) in the USA is vaccinated against a variety of ailments, some vaccines are required before you can enter public grade school; and more before you can leave and then return to the US. This cartoon and the dozen or two like it are deliberate and malicious lies. They should, imo, be sufficient cause for the ’toonists to be tried for malfeasance.

    The antivaxxers aren’t just endangering themselves, they are endangering everyone else. I had a breakthrough case after being fully vaccinated. But, more importantly, they are serving as mobile petri dishes for the next varient of the virus, and they get stronger as they mutate.

    (OT but after reading the paper this am I am pissed)The RQP is attempting to lay all the blame for Afghanistan on Biden. Sen Inhofe-R-OK stated in a press conference that the GQP goal was to drive a wedge between Biden and the military.Thus the entire GQP is attempting to rewrite history, again.(like they continue to do by pretending that Bush the younger simply never existed) The fact that T**** was the one who surrendered to the Taliban, that EVERYONE in Afghanistan was informed in April that the US was leaving by the end of Aug and they needed to get out. I guess they ASSUMED the US and NATO would never leave. Now the GQP are totally ignoring the emails that prove beyond any shadow of doubt that T**** attempted to pull out all US soldiers in Jan 2021 when he had less than 2 weeks remaining in office. He also wanted to totally abandon the Afghans who help the military for 20 years. Because T**** along with the current iteration of the Qpublican Party are racists.

    Oh yes, I also read this am that T****s butt boy Pence called Dan Quale(remember him? GHWs VP-the guy who could not spell Potato)to try and figure out a way he could worm around the laws and stage a coup declaring T**** president on Jan 6. Quale-amazingly enough-told Pence there wasn’t any way he could do that.

    So Pence wasn’t showing he had a spine or anything else that day, he was and remains T****s #1 butt boy. no b@!!s no brains

    Scott Stantis certainly doesn’t know anything about the Constitution. Mandatory vaccinations and inoculations have been something that can be made mandatory since the days of George Washington.

    Posting this in response to the Engineer’s and Ape’s comment/question.

    Jacobsen vs Massachusetts was a state issue not a Federal. It is also well over 100 years old and is doubtful it would stand today if challenged.

    Regarding the Engineer’s constitutional question, its answered all the time. Perhaps you’re not paying attention. In this case, Biden tried to do an end run around the law, constitution and separation of powers, by ordering OSHA to mandate vaccinations in the workplace. Biden also selected certain groups of people to get jabbed while exempting others, most noticeably the USPS. Now think about that one. The postal service is arguably the largest single group of people who are in direct and indirect contact with the general population of the US. Why exempt them? Heheh the postal Union would be first in line to file a lawsuit on the constitutionality. Right off it violates the “equal application” rules under the Constitution.

    Separation of powers, who has oversight and control over OSHA? Here’s a hint, it ain’t the POTUS. Congress has oversight and control over OSHA. Biden doesn’t have the constitutional authority to order OSHA to do anything.

    If you look at the congressional regulation establishing OSHA you’ll see that it has NO authority to mandate vaccinations. I’ve read it and such power doesn’t exist. Prove me wrong. You won’t because you can’t.

    This tramples all over State’s rights. The federal government has no authority under the constitution to mandate this. The States “might” under Jacobson vs Massachusetts but if challenged today it stands a very good chance of being reversed.

    Since Crackhead Rosie posted 7 days post-facto, and then did a victory dance witnessed by no-one, I thought I’d do similar (only 5 days later).

    First, you are correct that the SCOTUS case most directly relevent to the question was wrt/ a state law, and is 100 years old. I’ve not heard any legal scholars state that it would likely be reversed if before the court today. I think that’s fantasy, and would suggest that opposition to school vaccination surely would have followed that course were it likely to work.

    Second, your assertion that Joe Biden has no authority to direct a federal agency like OSHA is pure BS. He is the executive, and all agencies fall under the direction of the executive. It is true that congress passes the laws which an agency regulates with. If they are unhappy with an agencies regulations (enterpretation of the guiding laws) they are free to step in and correct the laws. To my knowledge they have not done that here.

    Third, OSHA is charged with ensuring health and safety in the workplace. Just because vaccination is not explicitly mentioned in the laws wrt/ OSHA does not mean it cannot be a factor.
