The founding fathers understood human nature as well as many and better than some. But they didn’t realize how corrupt career politicians would become. Remember: In their day, they knew that only gentlemen would have the ability to get away from working in order to work at politics, and they knew how gentlemen behaved. They expected cronyism and the like, but not outright spite. Originally, they set it up so the runner-up in the Presidential race would be the Veep: They expected people to work together for the benefit of the nation so much that they wrote it into the rules.
A clause to not confine criminals, what’s next, we open all the prison gates and oops, our bad, you’re all free to go and create whatever mayhem you like?

We would need that clause whenever Republicans control the White House and the Senate.
Of course, it would still be ignored, because when children die in cages, it makes the deterrent stronger.
