I’ll raise the quibble that Bush would not have won by all the measures and hypotheticals tried in the postmortem recounts. It’s true that Bush would have won a recount on the narrow grounds on which the Democrats pinned their case, and under most of the other tested scenarios: in short, as you say, the Supreme Court intervention did not alter the outcome based on the case before it. We cannot assert that the Court, maliciously or otherwise, prevented Gore from becoming president.There was a larger case to be made that systematic vote suppression and vote skewing had gone on for months, up through Election Day. Since the Dems failed to press that case, it was not adjudicated, and we are left with nothing but speculation.
