    For those keeping score, a highly respected married man in a position of global responsibility has (allegedly consensual) sex with a hotel employee he evidently never met before that moment.

    Now we get stories demonizing the housekeeper. This just might help him beat a rape verdict, but it still points to amazingly stupid, reckless, irresponsible and immoral behavior on his part. For all we know recent IMF policy has been dictated by mobsters who have film of him with other housekeepers. At the very least, the IMF should be investigating that possibility.

    Ironically, the story in the US has gotten other people in France to come forward with similar allegations and file charges there. And DSK has file counter slander suits.

    Which is a shame. A woman can be a rape victim regardless of what other crimes she’s committed. But since character impeachment has long been a tradition in defending a client against rape charges, her checkered past is denying her the chance to plead her case.

    Kind of agree with you there Clark. Still putting him in Gitmo would only give him attention he should not have. General population at any prison would do.

    English common law on rape isn’t a ‘he said, she said’ thing. The prosecution must prove sex took place (based on the story of Joseph and Pharaoh’s wife). A ‘Feminazi’ writing an op-ed for the NYT said that the woman’s word should be accepted disirregardless, she should need no objective evidence of sex provided by male forensic physicians.

    Under common law, once it has been proved that sex took place, the burden of proof is on the defence to prove she said ‘Yes.’ Defence attorneysslimeballs often claim that the victim’s clothes constitute an implicit ‘Yes,’ but this defence should always be (and often is) disallowed. Only a very clear indication of ‘Yes’ absolves the accused of rape.

    Of course, a taped call by the woman to her boyfriend saying that it was all a set-up is a valid defence, if that’s what it was. The supporters of the victim (if that’s what she was) say she knew about civil suits, and hoped to get some money for damages suffered, which is a perfectly legitimate desire on the part of a rape victim. Or was she saying she’d scammed a rich man? What the actual call by the victim meant will be argued for decades in law schools. Since she was told that the room was empty, a planned scam seems less likely, but an unplanned scam is still possible.

    But, at this point, nothing is clear, and, as with a certain woman in Florida very recently, or a football star in California a few years ago, under US law, anyone not accused of being an Enemy of the State is innocent until proven guilty.
