It’s only unconstitutional if a Democrat does it.

When logic and reason fail to arouse your audience, blame racism. Really Jeff, that’s a little weak and already used to the point of being a trite reference.

Reagan made 232 recess appointments, GHW Bush 78, Clinton 139, W. Bush 171.
I guess those nominated by Clinton were unconstitutional?

Gore actually won in 2000, so the 2000-2008 terms were a coup.

There is nothing in this cartoon that is factually correct, other than that these 3 judges were Republican appointees. Personally, I’d like to get rid of both recess appointments, and pro forma sessions of Congress. Both are ways to game the system.
Having said that, the difference in this case is that the Senate was in session, albeit a pro forma one. No other president making recess appointments has ever done so during a pro forma session. This is the reason why this particular incident was ruled unconstitutional.
I would also point out that this particular tool was wielded by Harry Reid to prevent Bush from making recess appointments on several occasions – and even though I think Bush was a bad president, he honored the pro forma sessions.

The judges threw out Obama’s appointees despite a century of precedent & laws that say a President has the right to fill vacancies in government with the people of his choosing.
These these judges are usurping Executive powers & hiding behind claims that the Founding Fathers wouldn’t like it. Strange that they’ve only arrived at that position now….

Recess appointments are constitutional if they are made when Congress is actually in recess. The Congress was not in recess.
Now Leftists are trying to blame Republican judges for upholding the Constitution??
.
For the President to make a recess appointment, the Senate must adjourn, and under Article I, Section 5 of the Constitution neither house of Congress can adjourn for more than three days without the other’s permission.
On January 4, the day Obama made the appointments, Congress considered itself to be in session.

When ‘W’ did same thing, you said it was uncontitutional
ARodney said, 4 months ago
Nope. Recess appointments are EXPLICITLY ALLOWED by the constitution.

@Joe
Gore actually lost in 2000 because he lost Tennessee, a State where he served as 4th District Congressman and then Senator before being named Vice-President Elect.
News for you. The 4th District he served and his Home County (Smith) and his Home City (Carthage) Voted for ‘W’. You have to ask yourself this question:
What do the residents of Smith County Tennessee, and The City of Carthage Tennessee know bout Gore the rest of us do not know that kept them from voting for him on 2000?
Had Gore carried Tennessee in 2000, he would have won without Florida, and here is math to prove my post true:
2000 Final Electoral College Tally:
Bush 271 – 11 = 260
Gore 266 + 11 = 277
Tennessee has 2 Electoral Votes
Another Question for you:
Why did Gore avoid West Virginia and Arizona in 2000? He avoided both states and lost both states.
