The oral part of the exam, answering questions before a group of people, is the part that is more in question rather than the written exam.
Blacks and hispanics apparently fared worse on the oral part than they did the written. Scoring the oral exam is, of course, more subjective than the written.
In this case, the written exam was 60 percent of overall score, with the oral exam counting for 40 percent.

nomad, that was just plain pointless. As you well know, Sotamayor is a) not yet a member of the Supreme Court, b) would not be the chief justice, and c) would only be one member of the court if and when approved. Oh, but maybe your point was to scare people into thinking that anyone appointed by Obama has the power to singlehandedly turn the Supreme Court into a despoiler of civil rights. Which, of course, is bunk.
