    Noonan: So you went into ONE Wal-Mart? Yeah, THERE’S good data. In fact, Wal-Mart employees are 66% female, but the managers only 33%. That is significant by any standard. Except the Roberts Court.They did NOT say the case was unjustified, they just said they don’t qualify as a class.

    ^ one of the great misconceptions on all sides when cases go before SCOTUS is establishing standing, not necessarily whether a Constitutional violation has occurred. If they don’t choose to hear the case, or return it to lower courts, or find a lack of standing (like class action), doesn’t mean the case is “settled”.
