Evidently the US Military is not so convinced he was a deserter. Else why would they have even wasted so much effort and lives even looking for him? Why not at least wait until he is debriefed and can tell his side of the story before condemning him?
Also, why are the ultra conservative types that originally wanted him to be rescued, now complaining so much about that very rescue? The thickness of the hypocrisy here is simply astonishing!
