    Chuck needs to check the history of what Appeals Court, and Supreme Court decisions HAVE led to. Sotomayor’s comment was quite accurate. Legal decisions DO mandate policy. Unconstitutional policies ARE blocked by the court, well until Bush.

    Looks like the last time Asay learned anything about our government was in the 6th grade.

    Unfortunately, most Americans are the same.

    All three branches make law.

    The legislature makes the black-letter law.

    The executive branch makes regulations (like income tax laws) and presidential orders (like Bush’s law to put us eight years behind in stem cell research).

    And the judiciary makes jurisprudence or common law, like “Innocent until proven guilty”.

    If you go look around a law library, you’ll find most of it is devoted to the latter.

    IMHO, you’re both wrong: the “making” of policy by the judicial branch comes under their mandate to “interpret” laws that are already there, or are suggested by other policy. The Executive branch “makes” laws under the powers its already deemed to be in charge of under its seperation of powers. And all of this confusion can and would disappear if the jokers we elect to the U.S. Congress would start doing their job and stand on principles rather than reward the special interests that paid to get them there.

    It has to do with applying a sixth-grade education to the real world.

    Stem cell research (from Embryos) will never work. So Bush did the right and intelligent thing. But how would you explain that to those who fell a baby is not a baby till it is out of the womb and wanted by the mother.

    Alito and Scalia are on the record as saying the same thing. Please show me the cartoons where you opposed their confirmations. If not, please admit you are not opposing Sotomayor on principle, only on partisanship.

    Pfft. The woman has a judicial record of hundreds and hundreds of cases. Taken as a whole, they show her judicial philosophy much more reliably than two comments taken out of context. The fact that some (but not all!) Republicans latch onto these comments shows that either a) her judicial record is mostly unobjectionable, or b) they’re just too lazy to go through it or even have their staffers summarize it, or c) both.
